These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and CraftCodely SRL ("Omniyond," "we," "us," or "our") governing your use of the Omniyond platform at omniyond.com.

By creating an account or using our service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not access or use Omniyond.

You must be at least 18 years old to use Omniyond. By using our service, you represent and warrant that:

• You are at least 18 years of age
• You have the legal capacity to enter into binding contracts
• You will provide accurate, current, and complete information during registration
• You will maintain the security of your account credentials

To use Omniyond, you must create an account. You agree to:

Omniyond is a Software-as-a-Service (SaaS) platform that provides unified access to multiple AI models through a single interface. Our service includes:

• Text generation (GPT-4, Claude, Gemini, Llama)
• Image generation (DALL-E, Flux, Midjourney)
• Voice synthesis and speech-to-text
• Document processing and analysis
• Chat history and conversation management

We reserve the right to modify, suspend, or discontinue any aspect of the service at any time with reasonable notice.

Your use of Omniyond is subject to the limits of your subscription plan. You agree not to:

• Exceed your plan's usage limits
• Share your account credentials with unauthorized users (except Family plan members)
• Use the service for illegal, harmful, or fraudulent purposes
• Generate content that infringes intellectual property rights
• Create malware, spam, or malicious content using AI
• Attempt to reverse engineer, hack, or compromise our systems
• Scrape, crawl, or data-mine our platform without permission
• Use the service to harass, abuse, or harm others
• Impersonate any person or entity
• Generate content that violates third-party rights or laws

Violation of these restrictions may result in immediate account suspension or termination without refund.

Omniyond provides access to various AI models including OpenAI GPT, Claude, Gemini, Llama, DALL-E, Flux, and others. You acknowledge that:

• Accuracy - AI responses may contain errors or inaccuracies. We do not guarantee the correctness of AI-generated content.
• Your responsibility - You are responsible for reviewing and validating AI responses before relying on them.
• No liability - We are not liable for decisions made based on AI-generated content.
• Third-party models - AI models are provided by third parties and subject to their respective terms and policies.
• Content moderation - You are responsible for ensuring your use of AI-generated content complies with laws and regulations.

We are committed to protecting your data. Our data practices are governed by our Privacy Policy, which is incorporated into these Terms. Key points:

• We comply with GDPR and applicable data protection laws
• We do not sell or share your data with third parties (except trusted service providers)
• We implement industry-standard security measures
• You can request account deletion at any time by emailing support@omniyond.com

• Uptime - We strive for 99.9% uptime but do not guarantee uninterrupted service
• Maintenance - We may perform scheduled maintenance with advance notice when possible
• Support - Support is available via email at support@omniyond.com
• Response times - Paid plans receive priority support from the founder
• Force majeure - We are not liable for service interruptions caused by events beyond our control (natural disasters, cyber attacks, infrastructure failures, etc.)

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Service provided "as is" - Omniyond is provided without warranties of any kind, express or implied
• No guarantees - We do not warrant that the service will be error-free, secure, or uninterrupted
• Limited liability - Our total liability for any claim arising from your use of Omniyond is limited to the amount you paid us in the 12 months preceding the claim
• Excluded damages - We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits, data loss, or business interruption
• User responsibility - You are solely responsible for your use of the service and any consequences thereof

You agree to indemnify, defend, and hold harmless CraftCodely SRL, its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from:

• Your use of Omniyond
• Your violation of these Terms
• Your violation of any third-party rights
• Content you upload or chatbot responses generated from your content
• Your end users' use of your chatbots

• Your termination rights - You may terminate your account at any time by requesting deletion via support@omniyond.com
• Our termination rights - We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or pose a security risk
• Effect of termination - Upon termination:
  • Your access to the service will cease
  • Your data will be deleted in accordance with our Privacy Policy
  • No refunds will be provided for prepaid subscription periods
• Survival - Sections regarding intellectual property, liability, indemnification, and dispute resolution survive termination

• Governing law - These Terms are governed by the laws of Romania, without regard to conflict of law principles
• Jurisdiction - Any disputes shall be resolved in the courts of Romania
• Arbitration - Before filing a lawsuit, you agree to attempt to resolve disputes through good-faith negotiation
• Class action waiver - You agree to resolve disputes individually and waive any right to participate in class actions

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last Updated" date. Material changes will be communicated via email at least 30 days in advance.

Continued use of Omniyond after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the service and may cancel your subscription.

• Entire agreement - These Terms and our Privacy Policy constitute the entire agreement between you and Omniyond
• Severability - If any provision is found unenforceable, the remaining provisions remain in effect
• No waiver - Our failure to enforce any right or provision does not constitute a waiver
• Assignment - You may not assign your rights under these Terms. We may assign our rights without restriction.
• Force majeure - We are not liable for failures caused by circumstances beyond our reasonable control
